Misdemeanor Criminal Traffic Offenses
Program Description
This diversion program is for defendants facing misdemeanor criminal traffic offense charges. The State will perform a risk/assessment analysis to determine which diversion program, if any, is appropriate for a defendant.
Program Requirements
Most non-violent misdemeanors with no aggravating factors and no requirement to pay restitution are eligible for the Adult Civil Citation Program (ACCP).
The following misdemeanor criminal traffic offenses are not eligible for ACCP:
- Traffic offenses for leaving the scene of an accident
- Racing
- Reckless Driving
- Reckless Driving Alcohol Related
- Driving Under the Influence
Diversion-eligible defendants approved for this program will be required to:
- Pay $175 program fee
- Waive speedy trial
- Pay educational course fee, if applicable
- Complete 10 community service hours
Some charges may also require diversion-eligible defendants to:
- Complete financial literacy course
- Obtain Driver’s License
- Submit proof of ticket payments
- Complete safe driving education programming

Defendants must apply for the ACCP program within 7 business days of being issued the civil citation. Learn how to apply.

ACCP Completion Or Failure To Complete
If an ACCP participant successfully completes the program the State will not file charges and will close the case.
If an ACCP participant fails to complete all ACCP requirements within the given time frame their case will be forwarded to the State Attorney’s Office for prosecution.
